No, I didn't take it as criticism Archie, thanks for making the effort to respond fella.

I know the comments made here are genuine concern and others passing on their experiences both negative and positive.

Where was the accident at? i.e. if it's along an A-road road where traffic's fast-moving I'd have thought it's unlikely a drivers' claim of under-taking would work, unless it's coming up to a junction/lights.


Exactly, it was on the A38 which is a very fast road. He was lost and trying to turn around and as Phil says above he forgot the length and the small bit about there being a cyclist in the way. Why he felt the need to overtake in the first place is clueless enough.

I suggested to the Police Officer that I was stationary when I was hit and that I hadn't, or couldn't have undertaken him but all to no avail. Just have to wait and see what the BC solicitors can do in terms of damages but not overly hopeful.

Oh well, it had to happen at some time I suppose. Luckily I'm alright and the bike is undamaged.
So, I phone British Cycling and go about it this way, having legal representation with them and I am going for civil damages.

This sounds like the sort of incident, had it occurred in most mainland European countries, it would have been the driver who had to scramble for legal advice etc.
Perhaps some day the UK will be dragged into conforming with its Euro neighbours on road traffic law.

At least your not badly hurt, and the bike is not damaged. Let the lawyers do thier stuff, chalk it up, wipe your mouth and walk away, life is too short.

I'm glad you're OK MR. It's pretty low of the driver to tell porkies. Don't let it eat away at you. Just stick in a claim and let it go.

Not advisable to do so on the bike involved in the incident. Don't use it. Any damage to it can be put down to your use of it afterwards, not the incident itself. Also any injury caused by the frame to you.
This was tried with me, but the bike was in the lbs when it was supposed to have been in use by me. Very good witness's indeed, for that part.

Have had it checked out by the LBS on the way back and there is nothing noticeable. Beyond that, what else can I do Classic33? I could take it back to the LBS for them to have another look? There are no scratches, dents - both mechanics spent a time looking over the bike and if there is anything structural, then how will that be proved in any case?

Luckily, the bike was not hit, I was shoved off the bike and the bike landed on the grass verge. In any case, I had to ride it back via the LBS.

Good to hear you're not too badly hurt. I appreciate you are unhappy with the Police response, but they have to think, what happens if this goes to court? It's just one person's word against another and there is no likelyhood of a conviction once lawyers get involved, so them proceeding is pointless.

Fair points TVC...it's just that over the last few years I can think of a number of incidents where they just haven't come up to scratch, both involving myself and loved ones and I earnestly believe at times they border on being pointless.

I take your points though, and ultimately CPS guidelines here are just as much to blame. Thanks for the concern.
