The driver who hit me wasn't prosecuted despite me spending time in hospital, having an operation, and her admitting responsibility. The arguement being that it wasn't in the public interest. Ultimately this meant that the taxpayer would spend lots of money and tie up resources to prove what the driver had already stated - that she properly cocked things up. I understand that the circumstances are different to your case, but ultimately the outcome would be the same - someone might get a slightly slapped wrist and lawyers make a lot of money.

Just an update on this, have spoken to my solicitor and the other party has not only accepted liability but agreed to a compensation package, so I'm very happy with the outcome - the financial compensation is much much more than expected and the damages incurred to clothing etc will also be paid separately. This was an out-of-court offer...

This is great news all round and I felt it right to give an update because the British Cycling solicitors have been fantastic. I have a Silver membership and I'd advise anyone thinking about joining BC anyway to do so, perhaps due the legal cover alone.

Judging on a lot of the stories shared here and countless places elsewhere, I think I've been lucky twice.

Excellent. As was said on another thread, I do like a happy ending. (All the more welcome for being unexpected, given the driver's earlier attitude and the lack of witnesses. Wonder what made them think again..?)

You know Swee'pea99, I think either the 3 month period to allow the driver in terms of liability made him think again or...the fact that my solicitor got a street level photographic map and pointed out that he - the driver - shouldn't have been crossing the road where he did, technically, also made his insurance company think again.

I think probably the latter but either way they did a sterling job.

Yeah...that would do it. Kind of redoubles one's doubts about the KFC Krew, wouldn't one say? You'd think plod might have noticed a little matter like, say, clear illegality.

Exactly. What is also ridiculous is that either a) he didn't see me which is cause for concern in itself or b) he did see me but decided for the sake of a few yards gained to overtake me before he got to the petrol station? The latter I pointed out to the police when the driver tried to say that I too undertook him, clearly implying that at some point at least, he had seen me in order to state that I undertook. All to no avail with the police officer at the scene who couldn't see how stupid a scenario it was that a driver would overtake, when waiting a few seconds is all it would have taken him to effect the same maneuver.

(There's a small town near here where the latter scenario happens all the time - you get overtaken only for the same dick in the vehicle that's overtaken you to swerve in, blocking off your own way in the process, to allow another oncoming car through. Not quite the same as above but borne of the same dumb mentality).
