The third outcome has not been considered:

The person reporting the incident will be identified as a complete nobber and troublemaker. The incident is so trivial that I can't believe that so many neurons have been devoted to deciding what to do about it.

I wonder if the OP's life is so unblemished by minor breaches of the law that he can point the finger with a clear conscience at all and sundry....

It's not an offence to cycle and use a hand held mobile phone. However it is possible for you to be prosecuted for careless or dangerous cycling.

I often see cyclists in town weaving among pedestrians phone clamped to their ear. Anyone think they should be prosecuted

The answer is yes, he is technically breaking the law!. If he was a member of the public would a police officer ticket him? I doubt it, words of advice would be given at most. I certainly have not handed anybody a ticket in these circimstances and I'm an absolute b'stard for giving tickets for using a mobile whilst driving. The biggest point to come out of this is public perception. Because of the job the Police (me included) do, then we should be more aware of public perception to our actions. Even stopping at McDonalds for a coffee whilst on duty gets an adverse reaction from a large section of the public. Nevermind that the officer has been on duty for 10 hours straight without a break. Would I criticise the officer for his actions. Not until I knew why he was using his phone. But the perception is that he using a mobile phone whilst sat in his car at a junction! It does not look good does it?

So. What was the officer actually doing? I'm a bugger for mobile phone use, and clamp down on it, and believe public perception plays a great part in confidence in the police. But I'd like to know exactly what the officer was doing at the time? As many have said, he could have been doing one of many things. Our fleeting glimpse doesn't tell us enough for me to make a judgement though.

It does if you have Super Vision like some on this thread seem to have... ;)

No the point I made was that the camera is not as clear, in fact its no where near as detailed as the human eyes vision which is why I could see it was a phone but the camera couldn't - well it could but not as well. No bionic vision just my eyesight is considerably better than the cameras.

You do like cycling round in a spiderman skin suit - perhaps the officer was reporting you to the fashion police ?

Na, dont use it anymore. The novelty has worn off. Altura team and Pearl Izumi Attack Bib Shorts. Sometimes I spice it up and add a bit of orange with the wiggle team. I can go into shoes if you're that sort of guy!
