I would ask them for a reasonable payment - not over inflated, and point out that if you come off at the same pot hole you will sue them for a lot more - then they might actually think about doing something about it.

Perosnally I do think it is worth a letter to the highways dept, I wouldnt spend a lot of time brow beating them for money, ok they are meant to maintain the road but dont have any money so I dont know how much help everyone getting a few quid off them will be in the long run.

Since you'd previously reported it and the council/local authority failed to repair it then they are liable for any consequent claims in relation to any incident. They're supposed to do regular inspections and most often any damage caused by potholes falls in between the last time they saw it - which is always ok (not) - and the incident date so they have a defence. Looks like they haven't this time.
