A case has established that RLJ'ing cyclists probably have only themselves to blame if they are in an accident at the crossroads where they RLJ. In this case, the taxi driver was held to be 20% liable for the accident but only on the basis that the taxi driver had been speeding it seems. Without that speeding, it would probably have been entirely the cyclist's own fault.

Malasi v Attmed for those who want the detail.

I am amazed at the 20% fault tbh, although I guess they can't condone speeding by ignoring it.
If they driver wasn't speeding, then he wouldn't have hit the cyclist... Just like if the cyclist hadn't jumped the light, then the taxi wouldn't have hit him!

A policeman tried that one me a few years ago. He was in an unmarked car behind me when a vehicle pulled out of a side road in front of me.

He said that I wouldn't have had to brake so hard if I had stuck to the limit.

I said that I also wouldn't have had to brake so hard if I'd have been doing 30mph over the limit as I'd have been tucked up at home when the vehicle pulled out.

I expect he enjoyed entering into a lively, informed and humourous debate on the subject^_^

I see the hi-viz thing rears its ugly head again.
Alaways makes me wonder "in that case, why do they allow cars in dull greys and greens?"

A bit of a mumble followed by the realisation that I was not being overly serious (see comment about attitude test).

Quick background, it was an otherwise empty dual carriageway, middle of sunny day, middle of summer and I was doing just a few MPH over, he wouldn't have been interested had the bus not pulled out.

I quickly accepted his point that I shouldn't exceed the speed limit and apologised, he accepted mine that the bus driver caused the greater risk, we moved on without even waking the girlfriend who was asleep in the front passenger seat and didn't believe that I'd been stopped at all.
