I was told 2015 and Pre 2015 it invalidates the warranty by Cannondale. The 2016 come with 25mm and can take 28mm. I had chainstay rub with 23mm that came up 24mm!

I'm going to check my chainstays tonight. I do get a little rub when climbing, which now that you say this might be the stays rather than the brakes. That sounds like it might be dangerous.

Where is the clearance issue at the rear when removing a wheel, at the brakes or elsewhere?

Elsewhere - clearance between the seat tube and the tyre. Brakes are fine if I let off the quick release. Well, I would have to give them a thump, but they would go through inflated.

Location
Loch side.

That's a pretty sad state of affairs. I'm sure you would be more than happy to add 10 grams to the frame just to make the seat stays a bit longer so that you can fit a variety of tyres in there.

I have a 2014 supersix evo with 25mm tyres. Clearance is certainly tight but no rub and no difficulty fitting or removing the wheel. Are you sure your wheel is properly dished?
