Apologies if this has already been posted, it did happen a few days ago.

I'm a former solider myself and I am frankly of the opinion that if a soldier cannot keep their cool in an "aggressive" situation, then they have no place in the military as they are a danger to themselves and their fellow soldiers. To use a potential discharge as a reason not to hand out a jail term is inexcusable.

That said, what are your views on the sentence and the summing up by the judge?

It has been posted but you're right. No use for the army, no discipline, just bullying.

"He told him: "This was outrageous conduct, people should be giving plenty of room to cyclists.

"You assaulted this unfortunate man going about his business.

"Cyclists do not fall out with drivers for no reason. Drivers get too close to cyclists.

"Cyclists have to make clear and draw attention to drivers' bad driving, but they do not expect to be assaulted as a result."

Well said that judge! Though a few months at her majesty's pleasure wouldn't have gone amiss!

It is an important aspect of entitlement within the military especially the army to know when to use force and to ensure it is for legitimate purposes. Also that the force employed is appropriate to the circumstances.

Unfortunately, I do believe that the judge should have utilised whatever sentence powers he had at his disposal. Mitigation / Impact statements etc, are an important part of the administration of justice, however, the soldier ought to have know that the uniform of the armed services is to represent the country at home and aboard, and that he should not use the physical capacities drilled into him, against whomever he wishes.

As an ex soldier myself, the whole ethos of the Army training is to enable "controlled aggression", this guy showed zero control and stepped way beyond the line. If I was his CO, I would have him drummed out asap. I would like to see the same rules for civilian life, where you can be dismissed for bringing the company into disrepute, applied to forces personnel. This sort of behaviour is totally unacceptable no matter what job you hold.
