I cycle in spain a lot (I live here) and I wear a helmet when doing rides. I also cycle in and out of gibraltar every day and obviously the border is swarming with different police from different forces. When im just cycling in and out of Gibrlatar, I and many others dont wear a helmit and have never had a problem.
