This is very sad. Mr Kenny obviously did everything he could do to be seen.

I don`t know why the mentioning of the cycle track bothers Graham. It is not any excuse for the driving but there is a valid question.

If you are on a busy road and there is a cycle track, why not use it?

The reasoning of "I don`t have to" is not a valid arguement in this case. It was probably put there to keep the bikes away from the traffic.

There is nothing in law that says you have to use a cycle path if one is there, he is entitled to use the road if he wants.

Without looking up the specific case details I think I remember the weather conditions were icy - road had been gritted, the cycle path hadn't.

Very few cycle paths are gritted or swept regularly - I think the only one I know of that I use is the Bristol to Bath path gets a little more than the average cycle path in terms of that here in the UK.

Saying he should have been on the cycle path is like suggesting that he should have been using a different route entirely.
Completely beside the point of the case which was about running someone down because of bad observation.

Another one that can't believe that after the Caddon case we're still getting lawyers arguing 'should have been on the cycle path'
I'm keeping an eye on the sentence. I'd like to think otherwise, but I bet we'll be here in the near future complaining that the way to guarantee a minimum sentence for killing someone is to drive a car.

Still recon that killing someone with a motor vehicle should carry a manslaughter sentance which I believe is about ten years to life.

Pitiful justice once again, showing killing a cyclist with your car is not even going to end up with a jail sentence and just 12 month driving ban
