Don't know of mr Kenny but still a terrible incident

I know the guy's lawyer has to argue for his client, but referring to the cycle path on the opposite lane really grates. Glad the judge set that one straight. Sorry for Mr Kenny. Another example of why I avoid A roads as much as possible.

This is very sad. Mr Kenny obviously did everything he could do to be seen.

I don`t know why the mentioning of the cycle track bothers Graham. It is not any excuse for the driving but there is a valid question.

If you are on a busy road and there is a cycle track, why not use it?

The reasoning of "I don`t have to" is not a valid arguement in this case. It was probably put there to keep the bikes away from the traffic.

There is nothing in law that says you have to use a cycle path if one is there, he is entitled to use the road if he wants.

Without looking up the specific case details I think I remember the weather conditions were icy - road had been gritted, the cycle path hadn't.

Very few cycle paths are gritted or swept regularly - I think the only one I know of that I use is the Bristol to Bath path gets a little more than the average cycle path in terms of that here in the UK.

Another one that can't believe that after the Caddon case we're still getting lawyers arguing 'should have been on the cycle path'
I'm keeping an eye on the sentence. I'd like to think otherwise, but I bet we'll be here in the near future complaining that the way to guarantee a minimum sentence for killing someone is to drive a car.

Yet if you hit a ped with a bike it's an outrage and you're locked up for a million years.

RIP to Mr. Kenny, he'll be turning in his grave at this pathetic excuse for justice.
