Stealing from other posts, we can't prove who the driver of a silver BMW that knocked a forum goer off their bike and didn't stop was. Does that mean we should all knock people off and not stop, as long as we can get away with it?

Do what Drago says - either pay up, or seek legal advice on what you can/can't do.

I'm not sure if speaking with the council will work, they may have sold the debt to the bailiff company and thus be out of the loop - isn't that how it works? (genuine question)

not suggesting he doesn't pay the original fine. just uses careful correspondence to avolid being shafted by legalised thugs. ( bailiffs)

theres a huge difference between the example you gave and what is being suggested isn't there.

The two aren't mutually exclusive. Seems to me asking a cycling forum has turned out to be a pretty smart move. He's got some good advice. The best of which, in my view, is go and talk to CAB. And take the whole experience on board - it's seldom a good idea to ignore this kind of thing because it generally catches up with you in the end, having gained a lot of weight in the interim.

I suspect that option went away a while ago.

Once it's been handed to bailiffs your options ar limited, although they may accept multiple payments

Just don't ignore them or wriggle as the cost will go up quickly

to be fair that does depend on what stage its actually at. it could just be one of those pay up or else threat letters. talk to the original creditor.

btw, bailiffs arent by law entitled to enter your home unless they have the police with them. and if they ring your bell and try to get you to take paperwork from them, politely refuse - theyre not legally allowed to make you accept it and youre not obliged legally to receive it.

dont give an inch to bailiffs coz theyll take the bloody lot if you do. sort it out on the phone with the creditor.

Lets be fair its a year late, thats not a crime its the amount they want now which is tenfold what the original amount that in my opinion is a crime! Find out if the bailiffs are employed on behalf of the council, if their not and sold the debt on , you have no legal contract with the bailiffs, so they can go and sling their hook. If debt is with councill contact them and explain your situation EG moving house and see if you can come to an agreement. ps as you been advised record everything . Best of luck and I for one are on your side

That's what I've been trying to say all this time. Lol The bailiffs have no authority to force him to pay. There's no legal contract.

There are quite strict processes that council most go through in order to pass a debt to a bailiff. This will include having put the matter to the county court and obtaining a warrant of execution. This is nothing to do with 'contracts with the bailiffs'...

Once the council has a warrant of execution then the bailiffs have the full force of the law behind them.



You have the right to ask the court to suspend this warrant. This means it won’t be put into operation as long as you keep to the terms agreed by the court. For example the court may agree to suspend a warrant as long as you pay a certain amount each month. If you fail to pay, the warrant will be re-activated.

To apply for a county court warrant to be suspended, you fill in court form N245. You can get a copy of this form from the HM Court Service website.

it is possible though. I turned 18 a few months before the financial year change and the Local Authority i lived in wanted an extortionate anount for 2 months "poll tax" ( yes "Poll Tax" not council tax) i refused to pay being a poor YTS apprentice. case went to county court I didn't attend was found guilty and then the bailiffs came. which was fun as everything in the house belonged to my parents except my tools and clothes , which they cannot take. they gave up after a few months . the council wrote to me again asking for payments so i offered £1 a week to pay off the original debt only. they realised they were onto a loser and accepted.

in the case posted though, deal with the council and folow Brains advice about with reference to previous letters. and make sure you have "copies of what you sent and when"

12 months ago I got a parking ticket for partially parking on double yellows. I appealed, mainly to delay paying the fine. Then we moved house and I forgot about it.

Fast forward to yesterday, we had a letter from he baliffs demanding immediate payment of £500 :'(

There's no way we can afford even a fraction of this, has anyone got any serious advice on how to deal with the baliffs?

so 95% of the years total for 2 months is fair? what world do you live in where that is an equal fair share. it was £4 a week MORE than I was earning on the YTS.
