Who told you that the driver would have to the driver awerness scheme? The RTC report has to be completed then any recommendations submitted, I. E prosecution NFA or any other outcome. The offer of a driver awareness scheme would seem to point to culpability on the part of the driver which would then in turn open the door to careless/undue.
Contact the OIC and have a chat, you should have a log number and your local police number should be 101.
Hope your wife feels better soon, and hope you are OK too.
 
@vickster, cps not needed for a lot of RTA offences, and also it's not down to the injured party to decide if a person is prosecuted, it's normally down to the OIC.

OIC (I've only come across that acronym as opioid induced constipation) ? Fair enough, I didn't know that. As said, I was asked whether I would like the police to consider taking action against the driver who knocked me off. Personally I said no given the circumstances, but it's an individual choice. I think it was part of the witness statement the police asked me to complete but might have been a separate form. It was 18 months ago nearly after all (not that we've settled yet)

@mythste, this might seem at odds to what is going on at present. But I'll repeat what vickster has already said, forget about what you'll be doing later on. Get yourselves sorted out at present, there's one of you in a hospital bed, concentrate on getting out of there, putting all your efforts into keeping going. Each of you will need the other to be there for them.

Assumption being made here, can you make a recording on your handset? Right now she'll be trying to work out what happened. Not the best thing at present(personal opinion), what could have been done different to have stopped it happening. I know in that thread I said get it down on paper as soon as possible, but if she's still on the spinal board, now is not the time.
I can't see how anyone could hold you or her to what was said whilst being taped to a spinal board being loaded into an ambulance. Put that piece out of your mind and if possible try and get it out of her mind.

That's up to you to decide whether you'd like to request a prosecution - although ultimately the CPS (edited, the police) decide based on the case put forward by the police.

How did the driver behave at the scene? Apologetic, concerned, or belligerent?

If I were you guys, I'd not even think about this for a few weeks, there's really no rush. Is your wife having to have surgery to fix the broken bones?

Note everything down, you don't need to bother about the medical stuff beyond the costs associated with travel to the hospital, appointments and so on as others have said. Your wife will need to see a medical expert as part of the Injury claim which you will presumably proceed with when you feel ready, that expert will request the medical records from all practitioners seen and will insert the pertinent parts of the notes into his or her report.

The solicitor will organise and fund private physiotherapy for your wife when she gets to that stage, presumably in a month or two at least. I personally didn't need to take up the offer as I was already seeing a physio on my private insurance which wasn't part of the network used by the solicitor's medical agency.

The driver was apparently in pieces at the scene, I was called shortly after and managed to get in whilst she was in to see her shortly after she was unloaded at the trauma unit. I can't talk for Sarah but I see no benefit in pushing for additional charges. Like I said previously, I should imagine she's probably in a worse place than we are.

Pleased to say no surgery required as far as we can see at the moment. Radial Ulner (sp? The ball of the shoulder!) is broken 3 ways but amazingly all still in place and elbow is a pretty deep, but not broken, fracture. Chipped Tooth, fat lip and fatter cheek top off the rest of the bruises and scrapes. Just waiting on overnight observation and possibly another CT scan to check for internal bleeding, but the fact they're unwilling to do another (4th) scan because of the radiation exposure suggests to me that they're not all that concerned.

Thanks again everyone, I've a habit of over cooking sensible mode with this sort of thing but lots of sweeties and bad jokes seem to have kept us sane and It's certainly nice to know we have options, especially options that don't require immediate stress. I'm sure I could have googled a lot of whats been said but you lot have really taken the edge off me doing that and it really is appreciated.

It was the officer who was also first on scene who visited us just after she'd been for her first scan.

Glad to hear that she's getting over the initial part, even if bad jokes were required, and that no surgery is required. The immobilsing of the head & neck is standard procedure, in possible head/neck injuries. Its sore and uncomfortable, not to mention worrying "what's going on & why's it taking so long". Time slows when you're on a back/spinal board, from the perspective of the person fastened down at least.
I'll be selfish at this point and say forget the driver, concentrate on yourselves.

You able to get some sleep?

The reason that thread was done was so that if ever someone needed this sort of information, its there in one place.

Quick update! (me and the hospital Costa are becoming pretty good friends at the moment)

Minor complication overnight, Poor Mrs feinted whilst trying to take herself to the bathroom. Stubborn arse. Not sure if its a result of a head injury or just the cocktail of drugs she's on at the moment. Alas, feeling better this morning apart from the impending stiffness.

Had a proper chance to look over her helmet this AM as well, it bloody worked! The left hand side had skid marks on it and I noticed that the polystyrene had compressed to almost half the thickness on the impacted side. I know a lot of helmets/situations/conspiracy theorists fail on this front so all the lucky stars have been counted. Just for reference I tried compressing the other side with my hands and couldn't budge it.

Passing the "non visiting hours" time by playing a game of sneak past the battle-axe of a nurse guarding the door. She is literally a scouse Mrs Trunchbull. Heh.

Minor complication overnight, Poor Mrs feinted whilst trying to take herself to the bathroom. Stubborn arse. Not sure if its a result of a head injury or just the cocktail of drugs she's on at the moment. Alas, feeling better this morning apart from the impending stiffness.

My guess is you've already been spotted, she's just letting you think you haven't.
Nice to hear she's been allowed to move. That is one big positive at this point.

Another quick update!

She's received a very apologetic text message and flowers with offers of thoughts and prayers from the woman that hit her. All a bit weird if you ask me but I suppose its better than an arrogant douche canoe. Showed her this thread a few nights ago and she's been really chuffed about how much anonymous support made her smile, so thankyou all!

We were planning a bike holiday next year so I really hope this doesn't put her off. I'm going to do my absolute utmost to make sure shes back on in her own time without me being a pain!
