The Cyclescheme is a hire system for the first twelve months, with an extended hire option for the next 3 years and only after that does formal ownership pass to you, so they would own it if you didn't take up the extended hire & transfer option.
The new owner (of the wrecked bike, I assume you mean - rather than the new one) would be the driver's insurance company, surely? The new bike belongs to whoever owned the old one, i.e. C2W..
