Work advise please

I work 37.5 hrs pr week full time. Over a 4.5 day working week.

I booked a annual leave day for this week. An 8 hour day.

So last week I noticed that I had 4 days to work with a day annual leave. But because I work a 4.5 day week I should really only work 3.5 days with one annual leave day.

I asked where my half day had gone. They said because of staffing issues they gave me my official half day on the day I booked my annual leave day. So this means they have changed my 8 hr annual leave request into a 5 hour annual leave and the rest is my half day.

So now I have no half day and have to work 4 full days.

I did not wish to loose my half day. They say I will get the 5 hours of annual leave back at a later date. But I would rather keep my half day than have my annual leave hours back.

So can they do this.


Also, I have been told that in the future they are going to do this to our bank holidays.

So we normally have a 3.5 day week with bank holiday on Monday.

But they said they will make us have our half day on our bank holiday day.

This means we will have to work 4 days he rest of the week instead of 3.5.

So the bank holiday day is made up as part half day hours and half bank holiday hours.

They said we can have our bank holiday hours at some other time.

But I don't want them at some other time, I want my full day bank holiday and my normal half day in the week.

Any ideas?

I think it might be tricky to explain, as people all have different working patterns and definitions of time off....

I think whether they 'can' is down to your contract. If you're really concerned, check that.

We work Bank Holidays as normal, and get the days in our annual leave. Personally, I prefer that, as I get to use the days when I want them, not when the state says we should.

In the current climate, I think having a job is fortunate. Quibbling over when you take half a day will seem picky to those without one....
 
The holiday seems a bit poor on their part but they are not doing you out of money. Just book two half days next time!

Re the bank holiday, that sounds a bit of a con as they are only giving you half a paid day instead of a whole day. But perhaps it is legit if they only do it for one BH in five.


To make it fair they need a funny system of some sort. I once worked somewhere that did not and all the part timers worked only on Mondays and Fridays, then they got every bank holiday going!

It might also depend on how your half day is contracted.

If your contract said, say, Mon, Tue, Thurs, Fri were full days and Wed was a half day then the day you book for leave would determine if you took a full or half day of leave. Leave booked for Friday would always be a full day while leave booked for Wednesday would always be a half day.

BH always fall on a Monday and so should then always be a full day off work.

However, check your contract carefully as to how your hours are scheduled during the week, and how flexible the employer can make it.

As has been pointed out, I think this will come mostly down to your contract.

However, provided they're not trying to diddle you out of half a days holiday (they've said you'll get that half day back elsewhere), then I wouldn't have said they're really doing anything wrong.

If you're not happy with the situation, this is one to talk over nice and diplomatically with your boss and see if there is anything he/she can do on a "goodwill" basis. But I don't think you would have a leg to stand on if you went down a legal route for example.
