Amazon scams. Any advice ?

someone, not amazon, ordered it and was charged for it by amazon

to be 'inertia selling', there would need to be intent by amazon to charge the recipient, clearly that's not the case, therefore there's no basis for invoking the related legislation, it is simply not applicable here

That is if you go by what you (probably rightly) think the legislation was intended to do, rather than what the wording actually says.

I was explaining how the scam worked.

And your first question "'Amazon' will send a 'courier' to get the item back. They keep the item and the payment falls through." - there is no payment that could fall through. The OP had received the item without making any payment, and no other payment had been mentioned.

The payment is made by the 'courier'. Amazon don't send out items without some form of pre-payment.

I don't understand this.

Why would the courier make any sort of payment, and to who?

And yes, I know Amazon don't send things out without being paid, which means either this hasn't really come from Amazon, or it has been despatched to the wrong customer.

The OP has paid nothing, so IF Amazon (or fake Amazon) ask him to return it, why would any payment be made that could then fall through?

I understand how this scam would work if the customer had actually been debited, they would be led to believe the courier was refunding them, then that would fall through. But that isn't what has happened here.
