It already has. I've been sat in court when the police officer basically said those words (but with phone instead of watch), when asked why he stopped the driver.
It would be possible to see that a driver had turned their wrist towards their face for long periods of time, but if the smartwatch were turned on the wrist so the arm could be kept in a normal driving alignment then only the eyes would give away its use.

You would still be looking downward/sideways, and you would angle your hand in a strange position to get the best view. Honestly it's really easy to spot phone users currently, which is why it's so irritating that they can get away with it.

There's no law on scratching (anywhere) or throwing snowballs. Cider is isotonic so no issues there either, depends how much I guess - drunk in charge? Talking on the phone on your bike may be 'without due care', but how else do you play fox and hounds on the club run?

or use google maps to find the road you have misplaced because Cambride is crap for signposts in the burbs

So is anyone actually fancying the Apple Watch at all?
Not here. Saw a cracking custom coded face for the Motorola smart watch recently, mind.

Although, in the back of my mind, I thought, I could probably buy a regular watch that looks like that for similar money, and the battery would last, like, 5 years.

None of the current watches have the features of Apple's effort though. Once Apps hit, it will be seriously useful!

I am very tempted for the fitness bits alone, but Apps will get very interesting.

I think if I was to buy a smart watch it would be either the Moto 360 or the LG G Watch R

I like that fact they look like a current design watch and not something from the 70's, but as it turns out the current batches of smart watches leave a lot to be desired on both the performance and battery life fronts so I will stick with my lovely Tissot T Touch 2 for now.

The Tissot is a lovely watch, fair play. It's a proper watch.

I am after something more than simply telling the time though.

Not me, at least not yet. Before I can be arsed it'll need to.do something a smartphone won't - carrying a watch AND a phone is hardly progress.

Then it'll need to be shock proof to a high degree and very water proof.

At the moment it's a gimmick, designed to part the fashionista from their hard earned.

Well mine has a Compass, Altimeter, Temperature, Alarm, Chrono and a sort of Barometer all accessible from a touch screen ............ oh yes and it tells the time as well.

But I know what you mean ;)

Fair point, but all standard watch related items. I want to be able to do very different things to this tbh.

I think the whole smart watch thing needs a while to settle down and decide what it is, there seems to be far too many ideas all going off in different directions at the moment. Also the whole thing where the watch needs the phone present to do anything useful seems like a load of old bobbins to me.

Still we have come on a long way from the radio watch I had in the 1970's the thing was HUGE
