yebbut, if the cyclist was with a mate who, quite legally, held no
driving license, then the application of the law would be inequitable-
the license-holding cyclist receiving a harsher punishment?

i believe people have lost their licences for riding drunk...?

fair play really...ive noticed cops getting firmer with idiots on bikes jumping red lights/riding without lights at night...again only to be expected in my book....(dont get me started on the brakeless posse :smile: :biggrin: )

I would guess that this is not a cycling offence but a motorway offence that happened to be committed while on a bike.

If he didn't have a licence, the points would presumably be remembered in the system, and applied if and when he ever got one - much as teenage joyriders can get points on licences they're not old enough to apply for.

why on earth was he on that road?? The A7 takes you more or less straight to the Forth Road Bridge.

You don't 'accidentally' stray onto that motorway. The M6 now turns into the M74 without any intervening non-motorway road. There's just no way he did not know he was breaking the law. He was being an arsed, stupid git who endangered his own lives and the lives of others, and he deserved what he got.

It's not a punishment. You don't have a right to hold a driving license, you hold one because you have proved yourself competent to hold one. If you're not competent to hold one, you should not be allowed to keep it.

By cycling on the motorway he proved he didn't know or couldn't obey the laws of the road. So it proved he wasn't competent to drive a car. Whether he was actually driving one at the time is irrelevant.

If there were two people attending a patient, one of whom was a doctor and the other wasn't, if because of their incompetence the patient died, would you argue that the doctor shouldn't be struck off because the other couldn't be?

bollocks he didn't realise.

also, it's a bit ridiculous him getting points on his drivers license, as if he hadn't had one, what would they have done then? That's discriminatory tbh.

has the bit of unmotorway-ized A74 now got an M in front of it?

It happens. People stray onto special roads from time to time. Some peds do it deliberately. They normally get a lift off. Some special roads aren't even that well labelled, one of the ones near me isn't.

As for the penalties http://www.direct.gov.uk/en/Motoring/DriverLicensing/EndorsementsAndDisqualifications/DG_10022425. I believe they got an MW10.
