I just read this. What an idiot. Why on earth was he not given a proper punishment when he left the cyclist for dead.

Fleeing the scene of an accident will result in a fine, maybe some points and in the rare case where someone dies 6 months in jail. We have no spare capacity in the jail system so everyone gets community service these days.

Unbelievable story in his actions and the sentence, what kind of deterrant is this? Cycling in this country is a death wish, I've felt that more than ever since I came back from cycling in France, a day doesn't go by where I'm on the road and someone is inches from me passing in a car at double the speed or more.

He should be given a life sentence.

This country is turning into a free reign for these people.

I'm going to contradict myself a bit as i didn't read the bit where the cyclist was unlit therefore hard to see in the dark. Maybe the "nobber" isn't totally to blame for the collision?,but his actions in asking the cyclist if he was ok then walking away while knowing that he clearly wasn't are unforgivable!

He should be in prison. Period.

Another incompetent judge :sad:.

As the judge said, he was given the maximum sentence possible under current law (fine, points, max 6 months jail if serious) and guidelines (no jail spaces so community service or suspended sentence). Put the blame where it belongs, at the feet of the politicians and law makers.

Okay, I'm prepared to take on the mantle of Devil's Advocate.

Firstly, this is a report of a trial in a tabloid - not a media source I'm personally inclined to go to seek out full and accurate information from.

Secondly, while on the face of it the driver demonstrated an amazingly callous attitude, his actions could have been those of someone not used to dealing with emergency situations and was in shock. He was, however, driving on the wrong side of the road, probably as he had done so for years at that point on his route, and may have fallen into that old trap of 'complacency breeds contempt.'

Thirdly, the cyclist apparently didn't have any lights. Of course, no-one deserves a lifetime of pain because of a bad decision, but riding in the dark (it was a February morning) without lights is a risk I wouldn't take.

No, my main concern about this report is that the judge apparently believes that cyclists should be wearing high-visibility clothing and not doing so is a contributing factor to any accident a cyclist might be involved in.

Howling at the judge is not justified in this case.

The milkman was charged with causing serious injury by dangerous driving.

He was found not guilty of that charge by a jury of his peers - people like you and me.

The judge was then left to sentence on careless, which is not imprisonable, and on leaving the scene, which carries a maximum six months.

The milkman did leave the scene, but the evidence is he reported the accident at the Post Office within 10 minutes.

It was early in the morning, few people about, so while you and me might have hammered on the nearest front door to get help, going to the PO in 10 minutes is hardly a serious case of leaving the scene, so that was never going to be prison.

Bloody scandalous. How the hell did he get away with not having a jail sentence? Makes my blood boil.
