Reading a little bit more about it, it seems he was originally charged with attempted first degree murder, but the jury instead indicted him on assault. I guess it comes down to what charge is most likely to gain a conviction and not be successfully appealed.

Of course, that could have just been a misaimed warning shot, from someone with exemplary military experience...
Of course, if he does break the law again he has to serve the remainder of his suspended sentence. And he has to go on anger management training too, so that's alright then.
