If the Police put the living fear of God into the driver, he may not name the offender but he'll sure as hell have a word or three with her.

Do enjoy the beer

Wasn't there a thread where it was said that all you have to say is 'no comment' to everything and the police won't/can't take it any further.

One possible, with it being teenagers, might be if the driver was in 'mummys car'?

How many insurance paying parents would be happy to have plod on the doorstep in those circumstances.....

Whilst doing my statement the radio was going pt pt
It was giving the details of the owner of the car
A bloke
But he had an oldish name - not a young boys name
So it could be dad's car....
W reg though.....still could be

Even with stuffed teddies on the rear sill? not so sure?

Might be an insurance scam!!!

Coul dget him yet

The crusher awaits!

Yep. Works every time.

Same if you get caught for drunk driving and as long as you refuse to give any samples they can't touch you for it.

Oh, and a copper can't arrest you unless he's got his hat on.

Is this a section 59 offence by the driver, especially if the assaulter can't/won't be identified?

Yes, in a nutshell.

The vehicle is being driven on a road in a careless and inconsiderate manner
AND annoyance/distress etc was caused to the Op.

Sec 59 doesn't create an offence per se, it gives a constable in uniform a statutory power to deal with the antisocial use of vehicles. However, legal challenge may yet prove the mattter has to be dealt with "found committing", so can't be dealt with retrospectively (though I am open to evidence of police forces using it thus)

A S59 warning would be highly appropriate for the driver, IMO.
It only needs a constable to have "reason to believe" which is a far easier test than required for CPS, Court, etc.

It's a shame more police farces don't seem to have allowed it to penetrate their operational practice.

Read on. I think Cubist is poking fun at some misconceptions here.

Doh I didn't read the whole lot.
But I did find the following from our very own member 'coppercyclist' who posted this....

........With the current system I would always advise my client to go no comment too if I was a legal advisor. Theres absolutely no benefit to telling the police anything in an interview - UNLESS YOU'RE INNOCENT! I promise you that when we do get innocent people giving us explanations, we do our best to invesigate those too. If you're guilty though, shut the hell up and you'll probably get away with it.
