Doh I didn't read the whole lot.
But I did find the following from our very own member 'coppercyclist' who posted this....

It depends very much on individual cases. What's more, Coppercyclist and I rarely offer identical advice or opinion. Not to say either of us are wrong. We clearly have differing experiences.

Echoed. When I said 'and you'll probably get away with it' than was probably more due to my cynicism of our whole system. It shouldn't be read as a golden rule that will 'always work without fail'. I still stand by the comment that if I were a legal advisor that's the advice I'd give a guilty client though!

I'm genuinely interested to see where this job goes now though... Can you keep us updated baldy? :smile:

I will be surprised if you get a result. If the car had been stopped around the corner with her in the seat it would have been so much simpler but it already has the potential to be as messy as hell .

If the driver plays ball, grasses her up and she admits it - no problem but unless this happens and without any independent witnesses dont expect much.

An up date

Called by PC Plod yesterday afternoon.

He said that he managed to find the girl who did the slapping.
Apparently it took some long investigating - I can imagine thumbscrews on the driver!
She was arrested.
She was 'talked' to about the possible consequences.

It was her final 'warning' so was not taken any further.

Forgot to ask about the driver - I will ring up and ask what happened to him.

I do feel a little let down but I feel okay on the bike and confident enough on the same road. I do have to say though that I am taking a slightly wider line now so that people think "not sure there is enough room" and wait.

By the way, a "Final Warning" is administered to a person under the age of 18 who has admitted an offence. It's more than just a caution or reprimand, because the young person has to have a one-to-one assessment with a Youth Offending Team officer, and between them they will work out why the person is offending, and what needs to be done to stop them continuing to do so. Generally speaking she will have to carry out some small scale restorative action, such as a letter of apology or whatever.

In order to receive a FW for the assault as described by baldycyclist, she must already have been known to the police and have received a reprimand. She now has a police record which will expire (like points on a licence) when she reaches the age of 18. It may however still be disclosable for certain job applications, and will show on a CRB check.

Don't feel guilty that she has got a record because of your incident.... she will already have entered the system for a previous offence. She won't have thought of it as sexual or dangerous at the time, just a good laugh. Fortunately she now has had it all spelled out, and may choose to act with more sense in future.

well done! sounds like the officer dealing has done an excellent job despite my cynicism . Dont feel let down, as stated a Final Warning usually means just that. She has been arrested and suffered the indignity of everything that goes with it (search, property seized and time in a cell, fingerprints etc)

If its her Final warning she aint really that bad!...(just verging on it) and hopefully this will keep her on the straight and narrow.

Final warnings do have a place in the system and I reckon its a decent solution along with words of advice for the driver.

If she turns the corner and gets some decent grades and does something then a 'little' misdemeanor will be ok on the crb check. I have employed some who have been DnD as a student. I mean who hasn't been? Just that some are lucky and don't get caught !

Oh dear - CRB record - hope the girl doesn't want to be a nurse/teacher social worker. Won't go down well that she has a 'record'. :biggrin:

For any unwarranted guilt that baldycyclist might be feeling, I rather suspect she already had one before this. Smaller interventions earlier are usually better at influencing large changes in direction later on in peoples' behaviour.

Great news. Restorative conferences/ meetings are a great idea, but, as a teacher, I'm sure you don't need to be told to avoid the temptation of simply giving her a piece of your mind. There's nothing more likely to get her to clam up and dismiss the "blah, blah ,blah" of just another old fool.........
