But what if the cyclist is a total dick! I have had two recently just come straight off the pavement in front of me without looking. Fortunately for them I was on my own blke and managed to swerve round them, delivering a few choice words as I did so.
As has been said before theres good and bad on both sides, these two had a total disregard for there own safety, but that also puts others at risks

It is only a starting point for civil responsibility - if the cyclist is in the wrong - for example jumped red lights then the motorist isn't responsible as far as I gather.

Exactly. Civil liability. Mind you, it's not what the pro-motoring media would have you believe.
