or he has a mortgage and kids etc to support and that's his trade

So he is allowed to drive and HGV illegally, and kill innocent people, so that he can pay his mortgage and maintain a lifestyle..

If keeping up a lifestyle is justification to undertake illegal acts and kill people then perhaps we should all time up full time bank robbery.

As was in the news this past week; there are drivers with more than 40 points on their licenses who are allowed to continue driving. This is the responsibility of the judiciary.
In the case of this driver, who was prosecuted for a relatively minor offense, the question we will never know the answer to is: would he have been prosecuted for Eilidh's death if the police had followed best practice in their investigation?

Whether the criticisms levelled at the police and cps in Eilidh Cairn's case and now in the instant case are justified, the whole sorry affair and shambles of the lack of investigation into and failure to properly prosecute the driver over Eilidh's death is a stain on the English justice system. The only conclusion that can be reached is that the lives of cyclists are cheap.

The lives of pedestrians would seem to be cheap too - bearing in mind the second road death with which this driver was involved, in June of this year.

Legal update: R (on application of Kate Cairns) v Deputy Coroner of Inner West London

http://thecyclingsilk.blogspot.com/

From the link above, what a total idiot this guy is and his remark made by some one who SHOULD have ideas, good ideas.

"PC Clark of the Collision Investigation [Branch of the Metropolitan Police] explained that he was unaware of anything which could be done to prevent accidents of the kind in which Miss Cairns was tragically killed".

Also he states "killed" rather than "died" which suggests an action by some body ........ an HGV driver by any chance? Does he know something we don't?

I have written to my MP (inspired by the See Me, Save Me campaign by the Cairns family):

Dear Ms Ruddock

On November 25th the second reading of the Road Safety Bill will be debated in the Commons (sponsored by Sir Alan Beith MP).
http://www.publications.parliament....0-2012/0191/cbill_2010-20120191_en_2.htm#l1g1http://www.publications.parliament....0-2012/0191/cbill_2010-20120191_en_2.htm#l1g1

This Bill proposes (amongst other safety measures) 'the fitting of equipment to heavy goods vehicles
to eliminate driver blindspots and aid driver awareness of cyclists, pedestrians and other road users'.

As a committed cyclist I am very distressed by the number of cycling fatalities and injuries in the capital,
with Heavy Goods Vehicles involved in a high proportion of those incidents.

Please support this Bill.

I think Tynan was answering the question "Why is he still driving?", whereas you want to know "Why is he still allowed to drive?"
