See what you're saying, but it *is* more complicated than that. There's intent to consider, then whether it's ball to hand or hand to ball, that sort of thing. IIRC it has to be clear cut and this one wasn't. It looked like the ball came off Chicharito's chest - might have flicked his bicep on the way through, but that's not good enough grounds to award a penalty.
If it had been, given, that'd have been very, very harsh.
