Actually, it's the OPs frame, having had his offer and payment accepted under contract law, and selling it on to a third party constitutes theft. "Unlawful misappropriation of the goods of another with intent to deprive the lawful owner thereof."
If it were me, I would explain this to the seller and give him a week to send the frame before you involve the police, if only to cause him anxiety.

The police would not be interested, this is a civil matter.
 
I haven't used Ebay as a seller much, but won't they still charge him as though it was a successful sale?

When I won an item which went for a low price (a DVD) the seller never posted or responded. I asked for a refund. The seller then popped up saying he had been away and refunded me. What is the betting he will relist it in the hopes of getting a better price.

Not so. It's a civil matter if the seller keeps the bike and returns the money, which is breach of contract. As soon as the seller takes action to sell goods which he does not own, as in this case as he has already received payment, it is theft, which is a criminal offence.
