I could not believe the tossers were advertising yesterday (Christmas day) on TV with the message , get all your presents on E Bay and make some money.

I've been looking for a cheap frame for a while now to build into a trainer bike. It's a good excuse to upgrade the groupset on my good bike. Super man logic.

I managed to win a crackin looking frame just before Christmas, paid with paypal inc delivery and sat back waiting for it to arrive.

A few days later, ie yesterday, I get an email, sorry got a better offer , I've sent you a refund.

How annoying is that, I bet if he had a non payer he would e p**ed off, I'm really suprised it's allowed by eBay.

So now that's out there, has anyone got a 56cm frame and forks that's going cheapish. Not to fussed about frame material but able to accept a bb386evo crankset would be a bonus.
Complain to ebay , that is not fare. He could possibly be chucked off ebay for that

I know it's no consolation, but at the end of the day it's his frame so he can do whatever the hell he wants with it really.

Actually, it's the OPs frame, having had his offer and payment accepted under contract law, and selling it on to a third party constitutes theft. "Unlawful misappropriation of the goods of another with intent to deprive the lawful owner thereof."
If it were me, I would explain this to the seller and give him a week to send the frame before you involve the police, if only to cause him anxiety.

Calling it theft is pushing it, but it is clearly breach of contract - you could sue for damages, being an amount to cover the hassle and perhaps extra cost of buying one elsewhere, if you sued in small claims court, for a modest but not excessive amount, you would probably win.

Personally i couldn't be arsed, but i'd complain about him to ebay, and leave shitty (but honest) feedback, and leave it at that
 
I was the only bidder on a cycle rack once and the seller wouldn't let me have it because my winning bid was under his "buy it now" price I explained that a B.I.N price is not a reserve and reported him ... what a p***t
