Have I totalled my bke?

I had a phone call from the guy telling me he has discovered a dent in his car, so I've been back to the scene. It turns out that in my non-concussed/shock state things look a bit different.

If the guy had stopped at the 1st white line, the accident wouldn't have occurred.

Having a look further down the road with the help of Google Streetview I have found a "rather helpful" street sign denoting the speed, however google has decided to blur the blimmin thing.

I'm guessing due to the lamp posts and number of buildings and parking bays that its a 30 zone? If so that makes me question why on earth the local council thought it appropriate to create an cycle-path rather than impliment some kind of on-road facility

Back to the OP. I think you may be in need of some legal assistance. With the kerbing through the road there it is extremely difficult for all involved to be able to tell who exactly has right of way. Is that classed as part of the road? Is it classed as a "drive way" style dropped kerb?

Other things to take into account, are there signs telling the driver to give way before the kerb stones?

Are you a member of the CTC, British Cycling or any of the local Campaign groups? If so then you should have legal support and insurance.

That looks iffy to me. For my inexperienced point of view I'd say it was more your fault than his. I've read the give way sign to be give way to the main road and not the cycle path. Also I'd expect a cyclist, like a pedestrian, to stop and look before crossing a road.
Usually shared use paths have blue signs like "cyclists dismount" on the approach to side roads etc, was there? Maybe this could be something to take up with the councils local highways department.

Certainly get in contact with somebody like the CTC legal department before arranging anything with the driver, it may well be that there are some funny rules around that part of the path that are in your favour or something. At the very least the council could get a beating for badlt designed and poorly signposted shared use path.

I completely agree. Sometimes you can contact the council over it and get more information, though. I tend to treat areas like that with extreme caution as you can garntee that someone else will assume ROY.

It's actually even more confusing as some points on that cycle lane have give way markings in the cycle lane. So I guess I'd argue that if other parts have give way markers and this doesn't then I have right of way?

Unfortunately people treat "priority" as ROY thesedays anyway... That little change in the HC didnt work. Side issue I know, but "right" never meant "you ALWAYS let me go first", its just the recent association with the Rights movements that seem to have clouded the meaning I think

I'd imagine if theres a geezer with a footie shirt on, photo'd from behind and they'd blur the numbers on his back too

Isn't that a raised pavement? That, together with the lack of giveways for the cycle lane, mean that the driver didn't have priority and the cyclist did, IMO.

Looking at the images you posted, it all looks bad, no give way lines anywhere to anyone indicating what they should do.

Take a look at this example of how a junction like that should be laid out in vauxhall.

I wouldn't like to guess at who's got priority there, it's not exactly clear that there is a cycle path crossing the road, and as a cyclist I would always assume that a motor vehicle will be approaching that junction very fast and not looking for cyclists on the pavement/shared path.

I don't know who is more to blame there, but I would question how fast you going that you a) couldn't stop in time when approaching a side road managed to right off a frame.

I treat shared cycle paths as a pavement that I'm allowed to cycle on, and don't usually go much above running speed, unless there are peds around, and at those speeds I could stop with a couple of meters. If I wanted to go faster than that I would use the road.

But I wish you luck sorting it out and that you don't end up too much out of pocket.
