... unless they were on fire at the time, of course.. in which case I'd pee on them *after* they'd smouldered out. :angry:

Again, appreciate all the support and advice.

Can finally draw a line under this and try to get back to biking.

The police caught up with the offenders and took their statements. They will not be prosecuting as the witness statement conflicts with mine with regards to the drivers position at the time of the assault (even though it was the passenger that floored me which we both agreed on). I had him outside, she had him back inside the van. The confusion arose (for her) as he did very briefly go back to the van.

The assailant's defense was that he was trying to calm things down between the driver and myself.

Unfortunately the CCTV was pointing in the other direction so no luck there.

Read a post about the CPS having limited funds to bring cases to court so this outcome doesn't really surprise me. Just wish they had told me a lot sooner.

In the mean time I haven't been back on the bike since the incident and my expanding waistline is testament to that! I've realised I NEED to cycle for fitness \ health more than the commuting convenience etc. that it provided.

Attempted to fix the bike over the weekend but realised that I needed a new hanger as well as the rear mech. Got one on order so hopefully I might get a days commute in this week.

That's crap - some right idiots out there.

Got sworn at by a van driver this lunch as I was cycling to work - he was reversing onto a main road (yes he shouldn't be) and this caused a bus to slam on the brakes, then the lorry behind it, and myself. I did such a terrible thing as to look at him as we passed.

This isn't good about the assault.

Pretty poor result, your description matches the witness apart from one minor detail but they decide to let the scrot off.

So, you have an independent witness agreeing that you were assaulted, you confirming the same offender, the offender accepting the assault but offering a weak defence to it. The discrepancy of a witness seeing another person, not involved in the offence at all in a different place to you.

And CPS won't prosecute on this? Pathetic. It doesn't surprise me, but **** me does it piss me off. It's so rare we get a good independent witness willing to attend court.

Wish there was the equivalent of the IPCC for CPS.
