Knocked Off (Deptford) - Can I do anything ?

To cut a long story short, last week I was knocked off my bike by a car hitting my rear pannier.
(For anyone that knows the Deptford area, it was east bound opposite the KFC on the Lower Road near the car auction place, just were the cycle lane becomes a bus lane)

The good news is only superficial damage to man and bike

The Issues and the Bad News

As this time of the busiest Friday of the year for the Police, and as no ambulance was required there was no attendance by the authorities (which I fully understand and appreciate - they can't be everywhere all the time)

The entire incident has been reported to the police including maps and witness statements etc

However the police are not going to do anything as very little damage was done.

I have now had a week to consider this, and I don't want money, but I do think the driver should not be on the road, (or at least a check to see if he is fit to drive)

As:
He cut across a bike lane, into a bus lane.
He hit me, should have seen man and bike fly past his window
Kept on driving until stopped by a cabbie and a couple of other cyclists
Still tried to keep on driving but could not as road was blocked
Refused to get out of car until I removed his keys
Claims he never saw me
Claims he never heard the bump

Now all of the above may possibly be reasonable. However, the driver of the vehicle was boss eyed, and I mean really boss eyed, one eye looking completely the wrong way, so at best he will have a large blind side.

It gets better - this guy is driving a minicab that specialises in moving patients from one hospital to another

Even if the police won't do him for:
Driving in a bus lane (only busses and plated London taxis can drive in bus lanes)
Or driving without due care an attention
Or leaving the scene of an accident

Could they at least check he is insured to drive a minicab ?
Does his insurance company know that he is visually impaired ?
Should this man be driving a minicab ? Should he be driving anything at all ?


Is there any way I can get the last 3 checked ?.

Civil lawsuit? It sounds like you'll get very little in the way of legal sanctions against him, at least you could make him (and his insurers) think about the bank balance. The large numbers of witnesses suggest a strong case. If you really don't want the money you could give any damages to charity?

His ability to drive and any illegal acts he made are really not for you to decide. Your sole concern is for restitution of any loss you have incurred. You have stated that you do not want money and have reported the matter to the cops. At this point, back out of the issue. Trying to 'do justice' will only depress you further. It is better to put the thing down to experience.
 
Sorry to hear about that! Have you had a look on askmid with his registration? (google it). Might be worth a punt...

So we now have a dangerous, visually impared driver, in control of an uninsured vehicle, doing hire and reward driving for the local hospital trusts.

How can I get the police to react ?

You and Yours on Radio 4 did an article on hospital transport subcontractors and dodgy drivers lately. You might stir up some action by writing to the police, the local hospital trust and your mp about it. (Letters CCd to MPs can be surprisingly effective, even if the MP stays out of it).

If this guy's driving uninsured, you can bet others are too. The company wants it's backside kicked. Or shutting down.

Actually, are you sure you have the right registration? I just checked it on the RAC vehicle chacker thingy and it comes up as unregistered. There could be reasons for it not being on. I don't know.

Double Checked - the registration is definitely VJ51 VRY,

So is the situation even worse ?

We now have an:
unregistered,
uninsured vehicle
being driven dangerously
and illegally in a bus lane,
by a visually impaired driver,
operating a hire and reward business.

Not surprising he did a hit and run, if I was breaking that many rules I'd be inclined to do the same

How do we get the Police to take a quick dekko ?

Surely some rookie copper would like a nice small arrest to bring his total up before the year is out.

As I have the (genuine) phone number(s) for this "minicab", The Copper could even have the car come to him !, Just has to make a call

Report it and leave it. You are not Hercule Poirot. I have too many friends get their heads messed up by police inaction on an obvious easily solvable crime.

If you want to make yourself feel better, write a letter to the Daily Mail. It would help your case with them if the driver was also an illegal immigrant.
 
I would certainly write to the Local Licensing Office if this vehicle has a "plate" and is Private Hie. Also write to the Transport Company and copy to the Chair of the local NHS Trust.

Don't get into an argument, state the facts as they happened, leaving out eprsonal assumptions such as the vision. Stick to what happened and provide the evidence thatthe vehicle is uninsured.

Simply express your concern about the lack of insurance and the poor driving that caused this incident, ask for reassurance that this is not their usual standard.

Finally (politely) ask how it is possible for the vehicle to be uninsured whilst carrying patients and what steps they are going to take to ensure the incident is not repeated
