I was given to understand after asking a driving instructor that if nobody is occupying a space in an empty lane which both have a legal right to use, but one has already indicated they are going to move into it, then the priority to do so would be given to them irrespective of whether they are coming in from the inside or outside lanes (my indicators were on, but his weren't).
That is what I'm basing my stance on. It is a logical one to take IMO.

From a social point of view I agree, if I was in lane 3 and saw you indicating in lane 1 I would give you priority. From a legal point of view, if there was an accident I believe it would go down as a 50/50 accident. Is there perhaps some confusion as to a legal priority and the priority that a good and observant driver would give?

asterix has the problem summed up in 1....but maybe it was the woman I looked down at from the truck this morning..coffee in 1 hand,,lipstick in the other,,,steering with legs,,,also managed to show me a middle finger when I shook my head before returning to put the lipstick on using the rear view mirror...nothing surprises me anymore...

I forgot to add something else. When on my Roadcraft and Bikecraft courses I was told that there is no need to give a left indicator when returning to the left after overtaking, even on a Motorway. As the first rule of the road is to drive on the left you dont need to inform other drivers that you are doing something that they should expect you to do, i.e. returning to the left. On a personal note I think it is good practice to use the indicator when I think another road user would benefit from it.

It is, but its also reasonable to assume either....

a) Linfy didnt see the fast lane car and therefore is a crap driver

or

b) Linfy did see the fast lane driver and assumed he could assert his right of way, and therefore is a crap driver.

I don't think you will be happy until you have without doubt established this in your mind Smeggers

Incidentally, saw a horrible near miss on the m62 / m621 junction yesterday.

white van man moved to the outer of the 2 lane slip road (start of m621), whilst white audi (i kid you not) woman decided to pull onto the slip road at the last minute... both swevered, lots of honking, lights flashing and hand gestures....

... the scary bit was the V shaped barrier they were both heading for which marked the split of the slip road and m62. scary mary.

It wasn't an Audi Q7 4.2 TDI quattro S line by any chance was it ;)
