Need advice on accident.

Had an accident back in May. Chap admitted fault drove straight into me while he was turning into a road on the main road I was riding straight down main road. Have reported to police submitted report to police once at station, then they paid a visit, then emailed never to hear anything from them again.

I didnt think guy had any insurance. Paid for bike to be fixed £150 odd quid. I want money back.
Get a text three days ago. Hi I have been away I will forward insurance details.
I then asked for them. Only to get text message I need proof as I have dilema as I have no proof of repair work etc or damage done to bike. I have taken pictures and have also proof of work undertaken. What is best course of action. Informed him he has broken law by not providing insurance details.

Who fixed the bike? Didn't you get a receipt?

And why does he want insurance details from you? You were on a bike and he hit you from what you've said!

Go back to the police although not sure what you'll do with his insurance details unless you're going to a solicitor.

I have a receipt and he hit me and admitted that he was at fault but is refusing to give me his insurance details.
Will phone police lunchtime as he also reckons they have not been in contact. Seems to also think he can claim on my insurance details for damage I did to his car even though he turned right without looking

Ah so there was damage to his car. Were there any witnesses as without it's his word against yours. Did he make a statement to the police admitting liability? Get advice from the police. If you have legal cover on car or home insurance, you could contact them too.

I still don't understand your first post about proof of repair? If he needs proof and you have a receipt, scan and email to him or post a copy

at scene he admitted liability didnt get any witnesses. I have receipt but dont want any personal info forwarded to him. Will phone police today have also phoned no win no fee see where I stand

If you proceed against him, he'll get your details. However, copy the receipt, black out the personal details on the copy and send that.

Were you injured in the accident? Probably only way no win no fee will help. Could try citizens advice too

Might be an idea to join ctc or British cycling in case need help with any future incidents. I don't think they'll help you retrospectively

How is he supposed to send you a payment if you won't give him your name and address?

Edit: And another thing, what is all this business about texting each other? You are in legally binding negotiations with the driver after the incident, texts don't really provide a suitable means of communication. You need to be sending some letters setting out your case and providing details (and copies of proof) of costs you have incurred. To be honest, I would be suspicious of someone trying to hide behind texts from an anonymous (untraceable?) mobile phone number trying to claim damages from me.

In this case I think you need to get a bit more official and show the driver that you mean business and will be in touch with his insurers whether he provides the details or not, so it is in his interest to play ball now and pay up or lose his no-claims! He probably thinks you will go away and stop texting him if he stalls long enough.

Did you make any deal with the driver at the scene. Even verbally. If so, you may have chalk this up to experience, with both sides paying their own repair bills.
If you know the registration of the vehicle, have you checked it should be on the road?
What made you feel that he had no insurance though?

Summatsup, so get everything down on paper. Including the content of the text messages. Including time & dates. Get your mobile phone provider to back up that you have actually sent messages to the number(s) you claim.

Then as others have already said, get legal advice on the situation.

Assuming you have the registration number, you can get his insurance details from askmid and then you claim for your damage directly from his insurance company.

Of course, he may not have told them, but that's his problem, not yours.

If he has no insurance you can claim from the fund for uninsured/untraced drivers.

Experience shows that's a bit more legwork than claiming direct.

go back to scene of accident and looks around for any security/cctv cameras and find who owns them and have they got the footage from that time period

tell police he is not spitting up insurance details and get them to run a search on their computer base using the reg plate to find if he is insured or not and if so find details and then contact his insurance company your self, this will hopefully show him you are serious and aren't going to drop it

Only a bit more! It does have two advantages though.
They will check to see if the vehicle is insured and its insurance history. They find its insured, then they will pass it onto the insurance company.
The form itself gives a very clear indication of what is expected from you in such an incident. Evidence wise.
