@Tin Pot you may need to get some legal advice but from when we were researching our extension here’s a couple of key points:-

- your neighbour is entitled to build the foundations on or under your land (detailed within the Party Wall Act) he should compensate you for this but there is a time limit

- the building control (not necessarily the council - we used a private company) will sign off the build at each stage I.e. foundation dig; pour; build to DPC level and so on.

Some of the replies on here are not factually correct so your opening comment was right!

We had next door (mid-terrace) rebuild their house, the back of their house fell off.
Thank goodness we had the Surveyor involved right from the start

Worth considering/noting that the utilitility services maps are as much as 40 years out. Unless there's work been done in the last few years.

Gas main(unmarked on a map) running through their garden, stopped a planned extension on a nearby house. They'd have had to pay to get it re-routed.

No, they're not. Ownership of all oil and gas in Great Britain (as well as all gold and silver throughout the UK) is vested in the Crown. Ownership of all coal is also vested in the state. In Northern Ireland, ownership of all minerals and gas is vested in the state.

Actually not.... the Crown technically owns all unmarked mute swans in open waters. Swans in other areas can be marked and are owned by other individuals - often by clerics and nobles.
I stand corrected :smile:They'll still break your arm though, given half a chance, no matter who owns them! :okay::laugh:

From a cursory read of the booklet linked above, they need to have given you formal written notice at least one month prior to commencing works, in addition to which they need your written permission within 14 days of receiving that notice for the foundations to extend onto your land. If these conditions have not been met then they are falling foul of the Party Wall Act.

Yes, that's how I read it. If they don't give you a party wall notice, or you don't respond agreeing to the work within 14 days, then they have to build entirely on their land, which presumably includes foundations, eaves etc. Has to be best sorting this out now - once the work is done, putting it right would be an expensive nightmare for all concerned.
