He is stupid. Stupid to have not recorded his whereabouts accurately, or stupid to get caught, then stupid to deny it, then stupid to huff about it, then stupid to feel let down by his team and ASO then stupid to turn up for B-rate races in yellow as it only serves to make him look irresponsible and immature. Stupid to behave in all this way when let's face it he had the ability to win the tour this year all along. legally or not.

Obviously if he was telling the truth and can prove he was in Mexico, then he will be able to go to court and get redress for wrongful dismissal. Surely the reported word of a journalist would be considered insufficient grounds for dismissal if he could prove that the guy was either mistaken or deluded? And with tickets and passport control records, proving your where abouts to no better accuracy than 'to the nearest continent', should be possible on any given dates.

Once he has established wrongful dismissal, he will surely have grounds for a civil claim to recover his potential earnings that have vanished since his dismissal ?

Of all the alleged wrongs that have been done to pro cyclists over recent years, this is one that must be possible to resolve quickly. Anyone seen any progress?

Assume for the purposes of this reply only that R was telling truth and he was in Mexico and lets assume he prooves he was there and not in Italy.

How do you resolve the fact he was denied victory in the Tour? do you strip Contador of his win? You can financially compensate him for his loss of earnings, but you can never compensate him for being denied the win in the Tour.
