I would think, Seeing as the the weld is still attached to the hinge plate, the weld has either rusted away from the post or the weld didn't fully take to the post when constructed.

That is my amateur interpretation too. I' d love a professional view

Then your solicitor should get a professional opinion from a metalogist. There are plenty of companies that will undertake microscopic examination and tell you exactly how the weld failed. I would suggest a joint inspection on behalf of both parties.


Too late for that new hinge installed - bolted to the post.

You therefore have to rely on Res ipsa locutor, the thing speaks for itself.

Someone had access to the gate and the gate breaking causing hurt was a breach of duty of care.

No brainer for a solicitor I would have thought

Modern "cast iron" gates are seldom made from cast iron, due mainlt to the cost.

No they're not at least when i built a few gates and railings they wasn't, they're just known as iron gates etc and are generally mig welded. Even the when welding the cast iron finials on to the steel rods they sometimes cracked around where the weld touched the cast.
