Amazon scams. Any advice ?

Just tell the “courier“ nothing got delivered.
I'm not sure what 'lenfield' is referring to "They keep the item and the payment falls through" What payment are you referring to ?

Ming said " just tell the "courier" nothing got delivered.

I do not need to lie if I wish to keep the item, I read this :-

" If you receive unsolicited goods (items you did not order) addressed to you, you can legally keep, use, or dispose of them as an unconditional gift. You have no obligation to pay for or return unordered items. It is a criminal offence for a company to demand payment for such items "

Having said that, Amazon have always treated me very fairly and often been very generous, and I would willingly return the item.

What payment?

No payment has been made, no refund is due, so no "refund payment" can fall through.

Do Amazon deliver without some form of prepayment?

If they do then the 'courier' just keeps the goods that have been delivered to the OP's address.

For the first time in ages I am waiting in for an Amazon delivery.Mrs P has Prime.I had three options,Pc World,Argos or Amazon.Amazon won on price.£60 cheaper than PC World,£30 cheaper than Argos.It was a no brainer.I normally like to see what I buy and Argos is only a twenty min walk away.PC is in town 30 mins ride,but cost won the argument.

that provision is specific to 'inertia selling', i.e. where a trader sends you unsolicited goods in the expectation that you will pay for them

it doesn't seem applicable in this instance as that's not what amazon has done

None of your posts have borne any relation to what has actually happened.

236Inertia selling​

(1)This section applies where a trader engages in the unfair commercial practice described at paragraph 31 of Schedule 20.

(2)The consumer is exempted from any obligation to pay for (or provide any other consideration for) the products supplied by the trader.

(3)In the case of a supply of goods that has not been requested, the consumer may, as between the consumer and the trader, use, deal with or dispose of the goods as if they were an unconditional gift to the consumer.

(4)The absence of a response from a consumer following the supply of the product does not constitute consent from the consumer to comply with the trader’s demand for the consumer to—

(a)pay for the product;

(b)return the product;

(c)safely store the product.

31Supplying products to a consumer that have not been requested by the consumer and demanding that the consumer—

(a)pays for the products,

(b)returns the products, or

(c)safely stores the products.

The products have been supplied (with correct name & address) without being requested.

If Amazon ask them to do any of those things, then it applies. If they don't, then he can obviously just keep it.

It may not have been deliberate inertia selling, but the law doesn't specify that.

someone, not amazon, ordered it and was charged for it by amazon

to be 'inertia selling', there would need to be intent by amazon to charge the recipient, clearly that's not the case, therefore there's no basis for invoking the related legislation, it is simply not applicable here

keeping it is a separate matter, and has nothing to do with intertia selling regulation, it's an unsolicited gift

amazon is clear in its t&c that if you receive an unsolicited item, you can keep the item, just let amazon know so that it can check the buyer's activity to see if they're doing something dodgy

for all we know, some random relative/friend simply decided to do it

Both your posts were talking or asking about things with no relevance.

In the post I responded to above, you were talking about a "courier", which has never been mentioned by the OP.

And your first question "'Amazon' will send a 'courier' to get the item back. They keep the item and the payment falls through." - there is no payment that could fall through. The OP had received the item without making any payment, and no other payment had been mentioned.
