Crashed into by WVM, can I keep/buy damaged bike

You won't need to pay the final payment IF you do not have the damaged bike any more. Been there done that - one bike was stolen a month or two before the end of my contract and it meant that I had no final payment to transfer ownership. However, you can't back out of the 12 month hire contract and must maintain your payments. Not sure how this would work if you retained possession of 'their' bike though.

Your hire contract will not apply to the bike you get via insurance either, so that is instantly yours (not your employers or cyclescheme's) on receipt. Hope that helps.

Sorry but is the C2W element irrelevant? Surely your claim is against the insurer of the idiot WVM. If the bike shop say it is a write off and it's only 4 months old, then it would be reasonable to get a new replacement bike paid for by the other side's insurer. Get a solicitor to act for you, preferrably one that specialises in cycling related PI claims.

I have had a solicitor from near the start, about 2 weeks in. The insurance company just keep ignoring my solicitors and now the matter is to be heard in County Court in August!!!! Why do car owners not have to wait this long ?

They'll probably settle two days before or the day before if they are B*£4^&*$!
