I dont think the police could break and enter for any cat, I would be thinking the scrote was caught and made the story up to get away with being on your property.........a call for some legal advice would be my first thing on the agenda tomorrow
Yes they can.

It doesn't sound like the act itself is unlawful, but the way the OP gas been treated over this is right shabby.

Regardless of the entry being made under S.17 of PACE you might still be able to claim. However, its a hideous piece of civil law, with more case law (and more settled out-of-court precedent) than you can shake a sheety stick at so it might be worth seeing a proper legal advisor and discussing the exact circumstances of your case with them.

Bombard them with faxes, correspondence and emails, especially an email every hour. They'll soon cave in.

No they won't. This isn't Tesco where they'll do anything to shut you up and get on with their lives.

The best that'll happen us they'll bat it all off to their legal team and thus our OP is wasting lots of time. They're police officers, forbidden by ACPO to become involved in civil disputes so their legal bod will by default have to manage any claim. Technically even the CC can't yay or ney it.

The worst that can happen is our OP gets stuck on for Harassment, or communications act offences, especially if he starts repeating himself every hour as you suggest.

Over the years I have personally been sent out to slap handcuffs on people who probably had quite legitimate grievances, who presented them in an unreasonable/unlawful manner as you suggest.

Just to update everyone, I thoroughly checked garage this morning, no cat, moved bikes out into house. But I am now in very big trouble, seriously big trouble, as the police turned up and next thing it went from bad to worse, worst case scenario. I can't see a way out and maybe lose everything. I have sought legal advice. I have been told by police that cat has now turned up. Police are now claiming my garage is not damaged. It is and they and my neighbour damaged it and I wasn't even at home. TBH damage to my garage is secondary as things have become very difficult. Thanks every one for your replies.

My advice would be to approach this calmly and purposefully. You will get your garage repaired, but ringing up and falling out with everybody in the process won't get everybody off on the right footing. You have to remember that not everybody knows why your garage was broken into, and they may not have the immediate explanation you demanded. Calm down and go to the police station, and ask to speak with a supervisor. Don't fall out with them, and they will bend over backwards to help you if they can. If you approach things from 50,000 feet in a blisteringly angry mood, you have nowhere left to escalate to.

Arrived home from work this evening to find my garage door all bent and hanging off the frame which is also badly damaged at the bottom where some one or persons tried to gemmy it open. My bikes, my bikes!!!! I got an even bigger shock when I found out the attempt to break and enter and damage was due to my scum bag neighbour under supervision of the police!!!! Apparently he told them his cat was inside, stuck for two days, so they rushed over to help him break in. Unbelievable. It is or was a fairly new garage door which is now very bent and the frame badly damaged. Inside I hope are still my bikes. As it is pitch black and my neightbour is rather volatile I shall maybe leave it until the morning.
The police can't even be bothered to turn out this evening. They REFUSED to tell me whether they had previously attended earlier to day and done it. I was getting passed around Cambridgeshire Police call centre, fobbed off, had the phone put down on me. I have told them to find some one to repair the damage and replace the main door asap but a duty sargeant told me that they will have to investiagate first and if they are found to be liable then they will pay but so far they acted under s.17 of PACE which means they are not liable where there is threat to life or property. I have neither seen nor heard ANY evidence of a cat in my garage not late last night, at 06:40am this morning or now, nor seen any notes from police put through my door.

Police have just been and told me there is only damage to the frame and my garage is now secure, they have taken pictures on their Blackberry and told me an Inspector will be in touch and left. The PC who put the phone down on me earlier also came along to accompany the sargeant although she didn't introduce herself and neither did her colleage, I had to ask who she was. I am still going to get the chap who installed my garage door to take a look at it and see if it is indeed secure or whether it is damaged as my neighbour and police forced the door twisting it to open the catches. Lucky my car was parked quite close so they didn't have too much room. I shall have to check the front of my car for damage as well. Absolutely unbelievable.

As if there isn't already enough crime without the police doing their bit to add to the crime figures.

As Drago has tried to say, if anyone else finds themselves in a similar situation, try a calm, reasonable and reasoned approach.

The police are reasonable people 99.99% of the time. If someone rings up and asks me to help out with an issue like Crankers's, than as long as we can do it calmly and rationally I will explain 1. Why it was necessary to break into the garage and 2 How to go about claiming compensation/recompense. I have a good deal of patience, but if people start ranting and raving, calling neighbours scumbags and bawling and shouting to the point point where I cannot put that explanation across, then I'm afraid helpful cooperation will take a momentary backseat.

2) make an 'official compalint' via the non-emergency number; practice what you are going to say & why, be polite, get the number of the complaint and the name of the 'person' who you were very polite to

3) check out if there any 'no win no fee' law firms who can supprt you?

The police clearly give more help to people who are causing problems than those who aren't. I shall take a break from here from the time being as it is probably better not to continue at this present time.

My neighbour has several harassment warnings issued against him not enter into ANY contact with me, cause annoyance or distress. The police have ignored these and he continues to allegations against me which are false. Last night I was fobbed off and passed from pillar to post by the police.The treatment I have recieved has been appalling. My comments weren't designed to be advice to you Crankers, I've been on here long enough not to presume to be able to offer you advice regarding your conduct with anyone, let alone the authorities. I respect that you have a very singular take on a number of matters.

Having said that I understand very well how dreadful disputes with neighbours are, and hope sincerely that yours is resolved as well as possible.
