If you can clearly get good footage of the driver, and of the mobile phone being held up to ear, and ideally see them talking into it, and then the vehicle details in the footage, then there is no reason why the police can't prosecute.

You would have to produce a statement covering the time/day/date/location, and what you saw, then include that you recorded it on a headcam (the police will help you there), then the police can take that away, get hold of the driver if possible, (from the vehicle details) and interview them and report them for summons to court.

i caught a lorry driver and a transit driver yesterday who were on their phoens and so oblivious to the world that they failed to see the marked patrol car as i came towards them, derew alongside them, and then passed them. One didn't see us until we had them turned around and put the blue lights on.......£60 lighter, and 3 points later.........

It is the one offence that really grates me. it has recieved so much media attention rant rant rant...........................

That's good news - does that apply in Scotland too ? I see so many drivers on mobiles every commute that it's shocking - especially when they have to steer with their knees around corners because they have to change gear with one hand and hold the mobile to their ear with the other ! Zero control of the car.

Yes and no – in my experience police were interested as footage was continuous, showed driver using hand held, and then the reg – but was told “as it was not witnessed by an officer in uniform” there would be no official action – but he made a note of her plate and said he would contact the owner to “have a word”

Bloody hell, she hit and killed someone, and is making excuses, saying that her actions where reasonable.

I hope they throw the f'ing book at her.


as to the police not accepting footage, I'd be talking up the chain, and possibly talking to local politicians to see what could be done.

I know we only have summarised version of the court proceedings to go by but the quotes given show an amazing lack of remorse or willingness to accept responsibility or her actions. Hopefully that attitude will be reflected in the sentencing. :tongue:

Agreed.

People who think like that should never be allowed behind the wheel of a car.

Perhaps part of the driving test now should be the mandatory question "Is it ever permissible to use a mobile for voice calls or text messages when driving ?". If they say yes, they fail. If they say no, then they can never play the ignorance card should they end up in court like this killer, as they obviously knew the right answer when they passed their test !

For real manual dexterity while cycling check out Amsterdam cyclists - dog in the basket, 5 kilos of cheese and a Van Dyke on the rack, no front brake and they're sailing through the rush hour traffic while texting.
