Had my bike stolen seven years ago and got an insurance pay out. What came into my bike shop today but my stolen bike. Guy who had it said he bought it at police auction a year ago. I'm inclined to believe him. I appreciate that once I receive a pay out then the bike belongs to the insurers but I'm miffed that my pride and joy was sold at police auction without me being contacted etc. Can I do anything or do I have to just suck it up? It was hard to see it come into the shop and do nothing about it.

Bike now belongs to those that paid you for its loss.

Was the bike marked? If not, I am not sure how the police would have known it was yours once the initial investigation passed...I can't imagine they have the resources to check back against their records when a bike is recovered after an initial period

Facts - you "sold" it to the insurance company. It was found and couldn't be traced to you so the police sold it off [besides - if it was after you had been "paid out" it wasn't yours anyway]. If you really want to offer the owner a fair price for it - it may be yours again if you really want it. Other than the scumbo who originaly stole it no-one has done anything wrong here.
