They seem like they are being reasonable but I would go through the insurance, full responsibility has been admitted and written down, apart from being a bad driver the guy at least sounds like he has some morals, you want a new bike and accessories and a few quid compensation for your pain and suffering, now I am not into thousands of pounds as seen on the daytime Sky tv adverts for injuries due to clumsiness or stupidity but where there has been proven negligence and resultant hardship the victim should be fully recompensed, what is done is done and cant be undone but I reckon the new bike plus £500 wouldnt be out of order.

Sometimes we over or under estimate pain and suffering, Chavs claiming for non existent conditions and people who soldier on despite being in a bad way, there is a middle ground, deep lacerations are pretty serious and I would imagine painful, so get what you think you are due, no more, no less.

Thanks all. Just got off the phone with CTC. Given them the police refereene number. They were v pleased with the driver having admitted in writing. I'm so fed up about my bike. Dawes Galaxy - the one I put new Stronglight, chain, rear mech, cassette etc on last summer. I'm so fed up.

Having been there myself go through the CTC. They will instruct their legal team to deal with it and they will get you a replacement bike if needed or repair, and personal injury compensation (which you are entitled to as this was completely avoidable on his part)

Secondly dont let them fob you off with a private payment. Their insurer needs to know this has happened, and with regards the employee it will rightly affect their insurance plan. The CTC guys will handle this, after all its what insurance is for. I will also say that the insurers will mess you around a lot less than some private individuals can, I have read time and time again of cyclists on various forums who have tried to settle privately and the driver suddenly changes their mobile, or disappears, becomes aggressive and questions the true value of the bike or changes their mind and blames the cyclist. Dont risk that, do it official.

Take pictures and video of all damage to person and property, keep receipts/bus tickets for travel expenses etc. Write down a list of all the gear that has been damaged and keep in mind a price for a new replacement that is of equal value and quality. Bear in mind that injuries will change over time so keep documenting those and take yourself along to the quack if it gets worse. It can take a couple of months to heal so take it easy. :biggrin:

Oh I'm so sorry to hear about this BonT. Not nice at all. I hope it doesn't affect your cycling confidence and that you're up and about with no pain soon.

I agree to let Mrs BonT know before she walks in and finds you like that. It'll make her worry more in the future knowing that you won't tell her when something goes wrong. She'll be able to hear your voice so that should help with her worry.

Do you reckon this is best? I thought it might be better for me to wait 'till she got in and and say - look, this has happened, but I'm in one piece and it's on the way to being sorted.

I don't know what's best.

Let her know, I agree with Hobbes' and Sh4rky's assessments, you know her best but she may want to come home and fuss over you.

Hello Beanz, that sounds like a really painfull bump. Lots of good advice here, do take it easy as you are not going to feel the full effect of this for a few days. Good idea to see your quack, sooner rather than later, so that they can record / treat your injuries and re assess damage after a few days.

Hope you recover quickly and have some fun building up a new machine!

Ouch. Sorry about the bump but sounds like you're on the road to getting things sorted... hope the injuries are ok.

BTW. How did you get the driver to put his confession in writing? Nice one!
