“Section 164 of the Highways Act 1980 says that barbed wire on land adjoining a public highway must not cause a nuisance to humans or animals using the highway. Anything placed below 2.4 metres high will usually be deemed to be causing a nuisance and the local authority can issue a notice demanding its removal”
There must be tens of thousands of miles of barbed wire fences along our minor highways and byways, all of it under 2.4 metres. What exactly does this mean?
If I duck through a barbed wire fence which doesn’t carry a warning sign is the landowner liable?
EDIT: a hint for your neighbour, leave the cage door open and accessible. Escaped guinea pigs usually return around dusk - at least our three did. I’m very fond of guinea pigs but my wife says no.
