I am confused. Did the van driver physically hit the cyclist when he was out of his van to warrant a prosecution and conviction for assault? The footage is not very good as the centre of the image is obscured by water/a rain drop. But never the less the van driver got this comeuppance. Ha-ha! Good he list his job as well. He'll find it hard to get another.

Another numpty here, even after watching it twice,
Agree it is a good result but just to clarify,
Did the driver hit the cyclist?
The van glanced me but I'd hardly consider it a strike as I stayed upright, police thought that and the angle of vehicle was worth mentioning in the report. However it was his actions outside the van that he was charged with.

A bit more detail on that aspect. I looked up the companies details and found the MD was a keen trail rider, after making contact I sent him the video, whilst informing him the police will be involved. MD gave the driver a chance to explain but he made up a load of rubbish (he wasn't aware of the camera) which resulted in him being unemployed within 24 hours of the incident.

I asked the MD what course of action would he consider 'best to be avoided' and he said a viral video with his company name all over it. I assured him that could be avoided.

fair play that he was given a chance to explain himself - a chance to come clean and take some responsibility, blew it

Many lessons to learn from this story. One of them is the benefit of increasing number of people taking cycling as a hobby.

I just find it a little disturbing that in order to get things done we have to rely on viral videos etc.

If the footage was clear this guy's face would remain on the internet for all eternity and would be first up when his name was Googled punishment enough I would have thought.

You don't have to actually be hit to be assaulted.

English law provides for two offences of assault: common assault and battery. Assault (or common assault) is committed if one intentionally or recklessly causes another person to apprehend immediate and unlawful personal violence. Violence in this context means any unlawful touching, though there is some debate over whether the touching must also be hostile.

Excellent result but as has already been said, would have been better if it didnt happen at all. However it did happen and it was good to see justice has been done. Is Emma Way still alive?
