It is illegal for a driver to use a phone whilst the engine is on, I know that but in my opinion it is a bit harsh, if you are not moving what danger are you causing? No I don't do it before anyone jumps to assumptions. What about the modern stop/start cars, the engine is not running?

I've made two 999 calls on the motorway, once when I noticed a car on the hard shoulder with flames appearing under the engine and another time when there was debris over the first two lanes that I managed to luckily avoid, I did not pull over and nothing ever came of it but I hope the fire service turned up quickly to the first incident.Even if you ring 999 you have to pull over unless something is stopping you(aka puts you in danger or someone else) like say your X is chasing you while you're in the car trying to kill you and that's why your ringing.

Question answered - In other words if your not parked your driving regardless of engine state. If you roll down a hill with the engine off are you not operating the car?
