The issue I would have, you send me that footage and show me it's a phone no doubt your human eye saw it but your camera eye did not do so clearly.

It is illegal for a driver to use a phone whilst the engine is on, I know that but in my opinion it is a bit harsh, if you are not moving what danger are you causing? No I don't do it before anyone jumps to assumptions. What about the modern stop/start cars, the engine is not running?

You then have to be parked, sitting in traffic with a stop start would still be driving the motor vehicle therefor still illegal. This is my view anyhow.

Already covered. I use my phone although it remains in my pocket unless I stop for a break(Bike version of parked up :P ).

But the engine is off so are you breaking the law? One for the resident coppers on the forum me thinks.

It’s illegal to ride a motorcycle or drive using hand-held phones or similar devices.
The rules are the same if you’re stopped at traffic lights or queuing in traffic.

Question answered - In other words if your not parked your driving regardless of engine state. If you roll down a hill with the engine off are you not operating the car?

Even if you ring 999 you have to pull over unless something is stopping you(aka puts you in danger or someone else) like say your X is chasing you while you're in the car trying to kill you and that's why your ringing.
I'm. Sure you don't need to pull over. I've made two 999 calls on the motorway, once when I noticed a car on the hard shoulder with flames appearing under the engine and another time when there was debris over the first two lanes that I managed to luckily avoid, I did not pull over and nothing ever came of it but I hope the fire service turned up quickly to the first incident.

When you can use a phone in your vehicle
If you’re the driver, you can only use your phone in a vehicle if you:
  • need to call 999 or 112 in an emergency and it’s unsafe or impractical to stop
  • are safely parked

He was stopped at a T junction. In turn he was on his phone not parked while operating the motor vehicle.
This is a technicality and in fairness i am not sure on how its viewed in the eyes of the law. Although I would suspect its along my lines.
