Your brother will have had a fiduciary duty to your Mum. It seems like me might have not carried this out properly, even getting your Mum to sign the Power of Attorney under duress or exerting undue influence. If she was suffering from dementia or the onset of it, then I think with advice from a doctor that this was the case so she might not have understood what she was signing, would mean that you could challenge what your brother has done. The rules may have changed some what since was involved with such cases as there were two types of Power of Attorneys basically medical and financial. Not sure if this is still the case. One of the witnesses had to be a medical professional if there was any indication that the person making the Power of Attorney was of unsound mind and iirc the Court of Protection would be involved. If your brother has done anything untoward and there is evidence then criminal sanctions can be quite severe. If he has assets then monies he has obtained illicitly can be clawed back.

HTH.

I think @Crankarm is correct about changes.

My older brother made me and other brother power of attorney while he was of sound mind, so that might be different again.

But I formed the impression the power we have, or at least the process to create it, is a recently streamlined one.

No idea who they were, but i think his latest woman might be one of them. Bloody corrupt but i bet they've covered their tracks.
I'd start kicking up a fuss if I was you. It all sounds very dodgy and they're a laws to protect vulnerable people. Social services aren't above it and as classic says, you might find they are not so protective of him as you think. Did you actually see a lawyer at the CAB or an adviser? If there latter, go back when there is a lawyer on duty. Or just have a preliminary appointment with a lawyer and get them to write a letter to social services to shake em up a bit. It will probably cost about £150 but it might be worth it. The very fact that no one knew he was gonna get her to sign is dodgy and if you really wanna stir up some shoot, the cops love a good a fraud case

At the end of the day, the best friend you'll ever have and the best family member you'll ever have is yourself. People are different to you entirely and things are exactly they way they are meant to be. I gave up trying to work out others pathology a long while ago. The people I have in my life are the people who are meant to be there. We treat each other with respect, we make time for each other and it makes no difference of time or circumstances, it always the same.

It's taken enough; time, effort and energy to work that out. Sometimes frustrations happen so you finally learn the lesson. You've got more chance of changing the weather in Peru than working out another human being. See that rock, that rock right there, it always has been and always will be a rock, accept it.

The feelings you have over the situation are totally justified because that's how you feel and you're entitled to them. However, the energy you put into situations out of your control you could put into the people who do matter.

I didn't see a lawyer,i sent them an e mail and i got that jargon reply back. I think i'll make an appointment to see someone from the CAB The reason i sent an e mail was because their phone lines are so busy, that's why i mailed them. E mails and letters are ok but i'm going to have to ask someone face to face how i stand on this matter and is it worth taking it further.

I think it might be worth chatting to some one legally qualified in this field. But ultimately what do YOU want out of it should you pursue it? Be careful of unintended consequences and what you wish for as they say.

Yes i know what you mean.I'm divided between taking taking the monster on and maybe losing, or just living in hope that the monster will meet his match one day and come a cropper.
